MyLearningTV’s moto is “Learn for a better tomorrow”. We have framed certain rules to keep the website/application safe & secure for everyone. These rules are applicable to all the activities on the website/application.Please read the Terms and Conditions carefully before registering and using our website/application/Services and products.Your use/access/browsing of the Application or Website or the Services or products or registration (with or without payment/with or without subscription) through any means shall signify Your acceptance of the Terms and Your agreement to be legally bound by the same.If You do not agree with the Terms and conditions, please do not use the Application or Website or avail the Services or products.

1. You are required to create an account to perform any activity i.e. to enrol in a course or to submit a course. You need to provide correct information i.e. name, contact number, email id, while creating an account. You should not share your password to anyone since the created account is your responsibility. The children below 18 years must invite their parents while creating an account. MyLearningTV can terminate your account, if any irregularities are found in your account.You may not assign or transfer your account to any other, whether He/she might be your relative or your colleague. You agree that your account is non-transferable and that all rights to your account and other rights terminate upon your death.

2. The prices offered are fixed and we would be collecting GST/government taxes applicable to the course.You are required to pay the course fee plus government taxes. You can use our third party payment partners to pay the course fee. You must not use any invalid/unauthorized payment method. By agreeing to these you are authorizing us to charge your credit/debit cards for our course payment. If we did not receive the fee and you get the access to the course, you must submit the fees within 10 days. We reserve the rights to disable any course access.

3. When any instructor provides us his/her course to publish on our platform, they authorize us to sell the course on our platform. We in turn authorize the students who enrol in that course, that they can view that course. The enrolment does not mean that the students can download, redistribute, copy, share, modify the content, resell the course. Enrolment only implies that students can view this course only for their personal use. We do not authorize any student to reuse the course in any commercial manner.We provide viewing rights to students after enrolment in the course for lifetime. But if the enrolled course is in violation of copyright law, we can remove the course and thus your lifetime access for that video will be removed.

4. We do not review or edit the courses for legal issues, and we are not in a position to determine the legality of course content. We do not exercise any editorial control over the courses that are available on our website and, as such, do not guarantee in any manner the reliability, validity, accuracy, or truthfulness of the courses. If you enrol in a course, you rely on any information provided by an instructor at your own risk. If you enrol in any course relating to health & Fitness, you acknowledge the inherent risks and dangers in the strenuous nature of these types of courses, and by enrolling in such courses you choose to assume those risks voluntarily, including risk of illness, bodily injury, disability, or death. You assume full responsibility for the choices you make before, during, and after your enrolment in a course.When you use our Services, you will find links to other websites that we don’t own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you.

5. We are not responsible for delay or failure of our performance of any of the Services caused by events beyond our reasonable control, like an act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions. It may happen that our platform is down, either for planned maintenance or because something goes down with the site. It may happen that one of our instructors is making misleading statements in their course. It may also happen that we encounter security issues. These are just examples. You accept that you will not have any recourse against us in any of these types of cases where things don’t work out right. The Services and their content are provided on an “as is” and “as available” basis. We make no representations or warranties about the suitability, reliability, availability, timeliness, security, lack of errors, or accuracy of the Services or their content, and expressly disclaim any warranties or conditions, fitness for a particular purpose, title, and non-infringement. We make no warranty that you will obtain specific results from use of the Services. Your use of the Services is entirely at your own risk. for example, if you enrol in a health and wellness course like yoga, and you injure yourself. You fully accept these risks and you agree that you will have no recourse to seek damages against even if you suffer loss or damage from using our platform and Services.

6. When you register to become an instructor on our website, you agree that you will provide and maintain accurate account information, you own or have the necessary licenses, rights, consents, permissions, and authority to authorize us to use your posted Content, you have the required qualifications, credentials, and expertise (including education, training, knowledge, and skill sets) to teach and offer the services that you offer through your posted Content.

7. As an instructor you warrant that you will not post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory content or information. You will not post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation (commercial or otherwise) through the Services or to any user. You will not use the Services for business other than providing tutoring, teaching, and instructional services to students. You will not engage in any activity that would require us to obtain licenses from or pay royalties to any third party, including the need to pay royalties for the public performance of a musical work or sound recording. You will not frame or embed the Services (such as to embed a free version of a course) or otherwise circumvent the Services. You will not impersonate another person or gain unauthorized access to another person’s account.

8. When you register to become an instructor, you provide us the rights to offer, market, sublicense, add captions to the posted content. You can remove all or any portion of posted content at any time. Except as otherwise agreed, MyLearningTV’s right to sublicense the rights in this section will terminate with respect to new users 60 days after the posted Content’s removal. However, (1) rights given to students before the posted Content’s removal will continue in accordance with the terms of those licenses (including any grants of lifetime access) and (2) MyLearningTV’s right to use such Submitted Content for marketing purposes shall survive termination.You grant us permission to use your name, likeness, voice, and image in connection with offering, delivering, marketing, promoting, demonstrating, and selling the Services, your posted Content, or MyLearningTV’s content, and you waive any rights of privacy, publicity, or other rights of a similar nature, to the extent permissible under applicable law.

9. You are responsible for all the content that you post on our website.We do not review or edit the courses. The content posted on our website should be in line with the law and should respect the intellectual property rights of others.When instructors post courses on our website, they make the promise that they have the necessary authorization or rights to use all the content contained in their courses. Infringing activity is not tolerated on or through our website. We can block your account for any major offenses or repeated offenses. You are solely responsible for the compliance with such laws and regulations that are applicable to you. You are solely responsible for any courses, content, and actions you post and their consequences. If we are put on notice that your course or content violates the law or the rights of others or if we believe your content or behaviour is unlawful, inappropriate, or objectionable, we may remove your content from our website. We comply with copyright laws. We may terminate or suspend your permission to use our website or ban your account at any time, with or without notice, for any or no reason, including for any violation of these Terms, if you fail to pay any fees when due, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems, or if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination we may delete your account and content, and we may prevent you from further access to the website and use of our Services. Your content may still be available on our website even if your account is terminated or suspended. You agree that we will have no liability to you or any third party for termination of your account, removal of your content, or blocking of your access to our website. If one of our instructors has published a course that infringes your copyright or trademark rights, please let us know. Our instructors are required to follow the law and respect the intellectual property rights of others. For any such claims you can mail us at copyright@mylearningtv.com.Knowingly submitting a false or misleading claim of infringement is illegal and you could be held liable and have to pay damages as a result.

10. As an instructor you retain ownership of content you post to our website. We’re allowed to share your content to anyone through any media, including promoting it via advertising on other websites. The content you post as a student or instructor remains yours. By posting courses and other content, you allow us to reuse and share it but you do not lose any ownership rights you may have over your content. When you post content on our website, you provide us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, modify, publish, transmit, display, and distribute your content (including your name and image) in any and all media or distribution methods. You also waive any rights of privacy, publicity, or other rights of a similar nature applicable to all these uses. You represent and warrant that you have all the rights, power, and authority necessary to authorize us to use any content that you submit. You also agree to all such uses of your content with no compensation paid to you.We can also make your content available to other companies, organizations, or individuals who partner with us for the syndication, broadcast, distribution, or publication of content on other media, as well as using your content for marketing purposes. You give us permission to share your courses for free with our employees, with selected partners, and in cases where we need to restore access accounts who have previously purchased your courses. You understand that you will not receive compensation in these cases.

11. We reserve the right in its sole discretion to remove courses, suspend payouts, and/or ban instructors for any reason at any time, without prior notice, including in cases where an instructor or course does not comply with our policies or legal terms. A course falls below our quality standards or has a negative impact on the student experience. An instructor engages in behaviour that might reflect unfavourably on MyLearningTV or bring MyLearningTV into public disrepute, contempt, scandal, or ridicule. An instructor engages the services of a marketer or other business partner who violates ‘s MyLearningTV’s policies.

12. As an Instructor, you don’t have a direct contractual relationship with students, so the only information you’ll receive about students is what is provided to you through the Services. You agree that you will not use the data you receive for any purpose other than providing your services to those students on the MyLearningTV website, and that you won’t solicit additional personal data or store students’ personal data outside the MyLearningTV website. You will indemnify MyLearningTV against any claims arising from your use of students’ personal data.

13. We calculate the gross amount of the sale as the amount actually received by MyLearningTV from the student (“Gross Amount”). Our revenue share model is very simple. When a student purchases your course, your revenue share will be 60% of the gross amount spent by student, which will be transferred to your wallet at our site. You can raise a request to withdraw that amount (except Rupees 1000/ the minimum balance amount in wallet). Once we will receive the withdrawal request, amount will be transferred to your bank account (account details updated at our site) within 3-4 working days. If a student asks for a refund after we have paid the relevant instructor payment, we reserve the right to either (1) deduct the amount of the refund from the next payment sent to the instructor or (2) where no further payments are due to the instructor or the payments are insufficient to cover the refunded amounts, require the instructor to refund any amounts refunded to students for the instructor’s courses. We’ll use commercially reasonable efforts to make any remaining scheduled payments that are owed to you before deleting your account. You understand that if students have previously enrolled in your courses, your name and that posted Content will remain accessible to those students after your account is deleted.

14. We are the owner of our website/application/services/products and things like our logos, API, code, and content created by our employees. You can’t tamper with those or use them without authorization.

15. From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and we reserve the right in its sole discretion to modify and/or make changes to these Terms at any time. Modifications will become effective on the day they are posted unless stated otherwise.Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
